Arbitration Update by Bill Harding

    On October 28, the three Democrat members of the NLRB reaffirmed a controversial 2012 ruling of the NLRB which was denied enforcement by the United States Court of Appeals for the Fifth Circuit.  In the 2012 decision, the NLRB only had three members and one of the three did not participate in the decision.  The other two found that an employer violates the NLRA by enforcing an arbitration policy which prohibits employees from participation in class actions.  On October 28, the 2012 ruling was affirmed but the two Republican members of the NLRB filed lengthy dissents.  The majority concluded that mandatory arbitration agreements "purport to extinguish a substantive right to engage in concerted activity under the NLRA."  The dissents concluded that it was not the duty of the NLRB to serve as a "protector" of class action rights under other sta ... January Networking Luncheons

 


 
Connect with other ABC members by attending the Omaha Networking Luncheon at Anthony’s Restaurant on January 21 and the Lincoln Networking Luncheon at Beacon Hills Restaurant on January 27, 2015. 

Speaker for both the Omaha Luncheon and the Lincoln Luncheon will be Kelly Ekeler from Harding & Shultz, P.C., L.L.O.  Ms. Ekeler will report on the ABC National Attorney’s Conference that was held in November.
 
Immediately following the luncheons, Beau Briggs, ABC Safety Director, will hold a short STEP “How To” session which will be helpful for you in filling out your 2015 STEP applications.

NLRB Issues Ambush Election Rule

    The National Labor Relations Board has adopted a final rule adopting the Ambush Election rule. The rule will be published in the Federal Register on December 15, and will take effect on April 14, 2015. According to the NLRB the rule will modernize and streamline the process for holding an election for union representation to authorize a collective barging agreement with a company. The effect of the new rule is that the election process / timeline is cut in half and many other things are established (see below). Labor law experts predict that under the new rule the election could be held in as little as 10 days. In short this means, let’s vote and then figure out what union representation means afterward! New OSHA Recordkeeping by Beau Briggs

    Previously, employers had to report the following events to OSHA: · All work-related fatalities · All work-related hospitalizations of three or more employees. Now, employers have to report the following events to OSHA: · All work-related fatalities · All work-related in-patient hospitalizations of one or more employees · All work-related amputations · All work-related losses of an eye Employers must report work-related fatalities within 8 hours of finding out about it. For any in-patient hospitalization, amputation, or eye loss employers must report the incident within 24 hours of learning about it.
